Initiation of Divorce/Dissolution

Filing fee:$250.00 deposit required at the time of filing.  Personal checks will not be accepted for payment of filing fees and/or costs.  (Payments are to be made in cash or with a money order, attorney check, debit and/or credit card.)  Any additional costs accrued during the course of the court proceedings that exceed the funds on deposit will be the responsibility of the parties.

All Divorce actions require service of the initial pleadings.  SERVICE COPIES MUST BE PROVIDED TO THE CLERK AT THE TIME OF FILING.  If you wish to have any time-stamped copies of the pleadings returned to you, additional copies will need to be presented to the Clerk at the time of filing.

Dissolution Without Children

1. Petition for Dissolution signed by both parties  (Original signatures required)
2. Separation Agreement signed by both parties  (Original signatures required) + 3 complete copies (Separation Agreement) (Modifications to the Separation Agreement can be made prior to or during the final hearing; Time-stamped copies with any amendments must be presented at the final hearing)
3. Waiver of Service of Summons signed by both parties (Original signatures required) (UDR Form 30)
4. Affidavit of Basic Information, Income and Expenses (Original required for each spouse)  (UDR Affidavit 1)
5. Affidavit of Property and Debt (Original required for each spouse)  (UDR Affidavit 2)

Dissolution With Children

1. Petition for Dissolution signed by both parties  (Original signatures required)
2. Separation Agreement signed by both parties  (Original signatures required) + 4 complete copies (Separation Agreement) (The Separation Agreement must include appropriate provisions for child support and cash medical support.  Modifications to the Separation Agreement can be made prior to or during the final hearing; Amendments must be presented at the final hearing)
3. Shared Parenting Plan or Parenting Plan  (Original signatures required) + 3 complete copies (Shared Parenting Plan)
4. Waiver of Service of Summons signed by both parties (Original signatures required)  (UDR Form 30)
5. Affidavit of Basic Information, Income and Expenses (Original required for each spouse)  (UDR Affidavit 1)
6. Affidavit of Property and Debt (Original required for each spouse)  (UDR Affidavit 2)
7. Parenting Proceeding Affidavit (Original required for each spouse)  (UDR Affidavit 3)
8. Health Insurance Affidavit  (UDR Affidavit 4)
